General conditions of contract

The general conditions of contract (hereinafter called “CGC”) are valid for all types of contracts that are concluded through the site byflowerbloom.com between Flowers Farm Srl and customers, who are consumers.
The consumer is that natural person who concludes a contract for purposes unrelated to any business or professional activity.

Approval of the Terms and Conditions

The customer accepts these terms and conditions and agrees to approve them, as soon as he places an order.

Defence clause

The inclusion of general terms and conditions or conditions of the customer that deviate from these terms will be rejected, unless they are explicitly recognized Flowers Farm Srl.

Internet presence on the website

The presentation of products on the website does not constitute an offer in the legal sense. It is an invitation to the customer to make an offer. The offer in the legal sense is in place when the customer places the order. The order confirmation takes place together with the acceptance of the order immediately after the automatic sending of an e-mail. Through this confirmation e-mail the purchase contract is concluded.

Product purchase and order process

In the product overview of the online store store.musa.digital the customer can select the product(s) by clicking on the “Add to Cart” button. The products selected during the visit of the online store will be saved temporarily. By clicking on the “Checkout” button next to the list of selected products, the ordering process will go on. On the next page, the customer will be asked to register on the online store with their login details if they have already placed an order in the past or by creating a new account. After registering, the customer can choose the place of delivery, payment method and provide payment details. The order data is summarized in an “order summary” before the order is released. The customer is free to check the data in the order summary and if necessary correct them, before concluding the order by clicking on “Send and Pay”, thus transmitting the data to Flowers Farm srl. By clicking on the button “Send and Pay”, the customer makes a binding offer for the products he has selected.

Order Confirmation

After receiving the order, Flowers Farm srl will send an e-mail notification to the e-mail address provided by the customer, which confirms receipt of the order and summarizes the content (hereinafter called “order confirmation”). The order confirmation does not constitute the customer’s approval of the purchase offer through Flowers Farm srl. In case Flowers Farm srl. rejects the conclusion of the contract, this is immediately notified to the customer by e-mail.

Characteristics of the Products and their availability in the different geographical areas

The Products are sold with the characteristics described on the Site and according to the general conditions of sale published on the Site at the time the order is sent by the Consumer, with the exclusion of any other condition or term. The images and descriptions relating to the products may differ from the actual product.

The Seller reserves the right to modify these general conditions of sale at any time, at its own discretion, without the need to provide any notice to users of the Site. Any changes made will be effective from the date of publication on the Site and will apply only to sales concluded from that date. Prices, Products for sale on the Site and/or their characteristics are subject to change without notice. Before sending the purchase order pursuant to the following point 3, the Consumer is invited to verify the final sale price. The Site can be accessed from anywhere in the world. However, the Products available on the Site can only be purchased by users who request delivery in Italy.


Right of withdrawal

The consumer is recognized the right to withdraw from any contract concluded under these general conditions of sale, without penalty, within 14 (fourteen) days from when the product was delivered. The deadline is calculated, in this case, starting from the day of receipt of the goods. To exercise the right of withdrawal, the consumer must send an explicit written communication to Flowers Farm srl at info@byflowerbloom.com to communicate its decision to withdraw. Subsequently the consumer will receive an email confirming the exercise of withdrawal, containing the return form to be included in the package, and instructions to proceed to the return of the product within and not beyond the next 14 days.

Pursuant to Article 59 of the Consumer Code, in case of purchase of services related to the enjoyment of a single audiovisual content or program, the right of withdrawal does not apply from the time when the customer has downloaded or otherwise enjoyed the content.   

Returns

A successful return is when all returned products arrive at their destination sealed and in perfect condition. A refund will not be made on products even once opened, used or without original packaging. We recommend that you pack the products well and ship them with a padded envelope or in a carton to our address. Any products that we receive broken or damaged due to improper packaging will not be refunded. The risks and direct costs of returning the goods will be borne by the consumer.

Our refund obligations must be met within 14 days. The period is calculated from the day of arrival of the goods in our warehouses. We will reimburse the expense using the same method of payment used in the original purchase transaction, unless expressly agreed.In this case will be charged to the consumer any additional costs arising from the different means of payment The refund may also be made by voucher, if agreed with the customer. Will not be applied to the customer additional costs. Our company has the right to refuse the reimbursement until it has received the goods or until the demonstration by the consumer to have returned the goods.

Keep in mind that:

– By credit card you will get a direct refund on your credit card.

 The Consumer is responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and operation of the goods. Therefore, if the returned goods are damaged (e.g. with signs of wear, abrasion, scratches, deformations, etc.), not complete with all their elements and accessories (including labels and tags intact and attached to the product), not accompanied by instructions/notes/manuals attached, the original packaging and packaging and the warranty certificate, if any, the Consumer will be responsible for the decrease in value of the goods, and will be entitled to a refund of the amount equal to the residual value of the Product. The right of withdrawal falls in the following cases:

  2. Contracts for the supply of goods that can spoil quickly and whose return has been made after the maximum return date;
  3. Goods returned after the maximum return period;
  4. Sealed goods that are returned without a seal;
  5. Edible or personal care goods that have been opened, used, or tested;
  6. Goods returned that are obviously opened, used, tampered with, damaged;
  7. Goods purchased in multi-packs and returned only in part.

Effects of withdrawal

If the customer withdraws from this contract, we are obligated to refund all payments we have received from the customer (with the exception of additional charges that result from the type of delivery chosen by the customer) within fourteen days of the date we received notice of withdrawal from the contract. For this refund, we use the same method of payment used in the original transaction, unless we have explicitly agreed otherwise; in no event will we charge fees for this refund. We may hold the refund until we have received the returned merchandise, or have received proof of return of the merchandise from the customer. The customer has time to return the goods to us no later than 14 days from the day he/she cancelled the contract. The deadline is met if you send the goods within the period of fourteen days. The shipping costs of the withdrawal are borne by the customer. Contracts for goods that are not prefabricated and for the manufacture of which there is a choice of the consumer or the goods have been adapted to the personal needs of users, can not be revoked.

Prices

All prices are total; they include the cost of packaging and value added sales tax (VAT).

In case of cash on delivery payment, additional costs are applied which are not shown on the invoice. These additional costs must be paid by the customer directly to the delivery person.

Shipping

For Italy by express courier GLS and UPS for foreign countries.

FOREIGN

  • € 15,00 for orders up to € 50
  • Free for orders above € 50

The shipment of goods will take place within 3 working days from receipt of payment, unless unavailability of stock that will be promptly reported. The delivery of the courier is usually in 24/48 hours (the delivery time for some places and small islands may be greater.

Correctly indicate the address where the delivery will take place and possibly the phone number that will be used only in case of problems with the order and delivery.

It is always advisable to indicate an address where there is always someone available to receive the goods. 

Delivery of goods and acceptance of shipment

The Site indicates the availability of the Products and the delivery times of the same, however, such information is to be considered purely indicative and not binding for the Seller. The Seller undertakes to do everything within its power to respect the delivery times indicated on the Website and, in any case, to execute the delivery within a maximum time of 30 (thirty) days starting from the day following that in which the Consumer has transmitted the order. In the event of non-execution of the order on the part of the Seller, due to the unavailability, even temporary, of the Product, the Seller shall provide written communication to the Consumer and shall provide for the reimbursement of the sums already paid by the Consumer for the payment of the Product. In the event that the Consumer has chosen the bank transfer as method of payment, the delivery term shall commence from the receipt of the payment by the Seller.

The shipment of the Products ordered by the Consumer will take place in the manner selected by the Consumer, among those available and indicated on the Website at the time the order is sent. The Consumer undertakes to promptly check and in the shortest time possible that the delivery includes all and only the products purchased and to promptly inform the Seller of any eventual defect of the products received or their discrepancy with respect to the order placed, according to the procedure set forth in art. 8 of the present general conditions of sale, failing which the products will be considered accepted. Should the package or wrapping of the products ordered by the Consumer arrive at their destination clearly damaged, the Consumer is invited to refuse the delivery by the carrier/freight forwarder or to accept the delivery “with reserve”.

Enforceability and retention of title

  1. The purchase price is due at the latest upon delivery of the goods.
  2. The delivered goods remain property of FLOWERS FARM srl until full payment 

Payments

  1. FLOWER BLOOM accepts the following payment methods: Credit Card (Visa, MasterCard, American Express and Diners).
  2. In case of payment by credit card, the amount will be charged only after completing the purchase.

Data protection provisions are contained on the site, under the heading “privacy”.

Severability Clause

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
